Please read our terms and conditions carefully before ordering, these
will govern any contract of sale that we, FreeSurf Ltd, trading
as AnyWebInternetSolutions.co.uk enter into with you, the customer. These Terms and conditions
do not affect your statutory rights.
Customer Privacy Policy
FreeSurf Ltd are committed to protecting your privacy.
We will only use the information that we collect about you lawfully
(in accordance with the Data Protection Act 1998) and according to the
Which? Web Trader Code of Practice.
We collect information about you for 2 reasons: firstly, to process
your order and second, to provide you with the best possible service.
We will not e-mail you in the future unless you have given us your consent.
We will give you the chance to refuse any marketing email from us.
We will never give or sell your details to any third party.
The type of information we will collect about you includes:
your name
address
phone number
email address
credit/debit card details
We will never collect sensitive information about you without your explicit
consent. The information we hold will be accurate and up to date. You
can check the information that we hold about you by sending us an email.
If you find any inaccuracies we will delete or correct it promptly.
The personal information which we hold will be held securely in accordance
with our internal security policy and the law and the Which? Web Trader
Code. If we intend to store your information outside the EEA (European
Economic Area) we will always obtain your consent first.
We may use technology to track the patterns of behaviour of visitors
to our site. This can include using a "cookie" which would be stored
on your browser. You can usually modify your browser to prevent this
happening. The information collected in this way can be used to identify

General Terms
Only persons of 18 years or over may order from our site.
All goods are sold subject to availability. If for any reason we do
not supply the goods ordered by you, then we will not make any charge.
However we are not liable for compensating you for any losses which
you may suffer if we do not supply the goods.
We will supply goods, which are free from defects in materials and workmanship
for a period of twelve months from the date of delivery.
We reserve the right not to supply goods and services.
The price of goods on our web site is shown including and excluding
VAT, but exclusive of optional delivery charges which may be chargeable
and will be indicated to you at the time you place your order. VAT will
be charged at the current UK VAT rate on all sales.
Goods remain the property of FreeSurf Ltd until payment is received
in full.
Any software ordered from us will be supplied with a publishers licence.
The terms of this licence must be complied with in addition to our terms
and conditions.
The stock levels shown on the web site are for guidance only and are
based upon the stock available from our buying groups central warehouse,
not our retail premises. Their may be goods available at our retail
premises which are not shown at our main warehouse. If you order via
our Internet site then the Internet prices will apply. If you order
or buy goods at our retail premises then our shop prices will apply
and although goods collected from the shop do not have a delivery charge
they are priced higher than the Internet prices to cover the extra overheads
associated with retail.
Orders must be paid for in full before they are dispatched to you, unless
we have agreed otherwise. If you are a business and wish payment to
be placed on Account then you must first have set up a credit account
with us. Please refer to the Section below on Opening an Account.
These terms and conditions are subject to change at any time without
prior notice being given, although if you have subscribed to our email
service you will automatically receive an updates approximately once
per year.
Educational & Local Government Orders
We accept Local Government Authority orders, but you still need to complete
a credit account application form and thereafter enter your order number
when placing your order as well as to fax us a copy of the educational
order. Mark your order "Confirmation of Internet Order"
Credit Accounts may be opened at our discretion for Government Departments,
Educational Establishments, Local Authorities and certain incorporated
businesses, subject to status. Credit Accounts are subject to a minimum
initial order of £200 + VAT and subsequent orders of not less
than £100. Credit accounts must be paid strictly to the terms
we agree which shall not usually be more than 30 days from date of invoice.
Delivery of Goods
A delivery charge of between £2.50 and £9.00 applies to
all on-line orders for non account holding customers. Delivery default
charges cost £6.00, but if you have placed a large value order
or you have only ordered light weight goods we may reduce your delivery
charge accordingly. Account holders will have individually negotiated
delivery terms. Delivery to addresses other than Mainland UK (excluding
Scottish Highlands and Islands) may invoke additional charges. Customers
in these areas should place orders as normal and we will contact you
to arrange a quotation before shipping any goods.
We try our best to dispatch on-line orders for stock items very promptly,
usually same day. However we cannot be responsible or liable in any
way for any delay which may occur, although where possible we will keep
you informed. More urgent guaranteed deliveries can normally be arranged
at an extra cost. Please ask us about the available options if you need
your order urgently. Orders may be collected from our showroom which
helps to avoid any carriage charges but the order should still be placed
via the Internet to qualify for the Internet price.
We endeavour to fulfil and ship all orders within 1-5 days, even if goods
were not in stock at time of order. If speed of delivery is an important
issue then you are best to advise us of this when placing your order.
Opening An Account & Pacing Orders
Due to the extremely competitive pricing we offer to cleared funds and
credit card customers we do not give out many "credit accounts". However
if you have a business of extremely good standing with absolutely excellent
credit ratings and wish to open up a credit account with us then you
will need to contact us and request a credit account application form.
To place an order you must have been issued with a user name and password.
You can complete our on-line registration on this site to get your details.
Placing An Overseas Order
We only except orders from outside of the UK, (due to a high incidence
of fraud) in certain instances. Please therefore note the following
for all overseas orders.
Payment should be transferred directly to our account at the cost of
the customer and then guaranteed by our bank to be cleared before we
can despatch goods or services.
We only accept overseas credit cards for certain purchases such as Internet
Solutions, like domain Names and Web Design
We do not accept overseas cheque's.
Damaged Goods
There is a time limit for notification of claims in respect of you receiving
goods in a damaged condition. Should this situation arise you must inform
us within 7 days. You must retain any damaged packaging, as it may need
to be examined. If you do not notify us within this period then we shall
not be liable for goods said to have been damaged on receipt. This does
not affect your general warranty rights under the sale of goods act.

Pre-Sales Enquiries
If you require more information about a particular product then we suggest
you visit the manufacturers web sites for up to date information or
email ourselves. Please check the specification carefully to ensure
that the product meets with your requirements before ordering and make
a note of the manufacturers product code. You can use this code when
searching our web site.
Pricing Policy
It is our intention to be extremely competitive. We believe that all
prices are correct at time of publishing E & OE. All prices are
in Pounds Sterling. Prices and specifications are subject to change
without notice.
Payment For Goods
We accept all the usual methods of payment although some of these will
be subject to cleared funds being received in our account, prior to
shipping. We also accept payment by Credit Card or if you have a credit
account with us then you can charge the goods to your account. If you
do not wish to enter your credit card details on the Internet then please
call us and we will take your details over the phone. With credit card
orders certain additional security measures may need to be taken. We
will contact you about this after we have received your order. When
paying by credit card goods will only be delivered to the card holders
address and we do take extra precautions on credit card sales. If you
have incorrectly placed an order then please contact us and ask for
our Customer service department or email us on e-mail: sales@freesurf.ltd.uk
All goods remain the property of FreeSurf Ltd until full payment
is received.
Returns Procedure
If for any reason it is necessary to return goods to us then you must
ensure that you follow the following procedure. You must contact our
customer services department for an RMA (Returns of Merchandise Authorisation)
form. You will need to fax back the completed RMA form to us with details
of the faulty product. On receipt of these details we will issue an
RMA number.
Please Note:
Any goods returned without an RMA will be refused and returned to the
customer.
Right To Cancel and Refunds Policy
All customers have a right to cancel their order as long as it cancelled
in writing. It is our intention to ship all goods within 1-5 days, unless
otherwise agreed.. Therefore if you have not received the goods ordered
within 7 days then you should advise us preferably by email. In any
case it should be noted that we will make every effort to contact the
customer and advise them of any delays and at that time give the customer
the opportunity to cancel their order. If for any reason you are unhappy
with the goods we have shipped you, (unless the law permits or states
otherwise, as maybe the case with software in relation to the copyright
laws) you may cancel your contract with us for up to 7 days after receiving
those goods. In all instances of goods for return the customer is required
to pay for the cost of returning the goods to ourselves. We will then
offer you the choice of refund or replacement. If you choose refund
then we will refund the price paid for those goods in FULL within 30
days so long as the goods have been returned in FULL including all packaging
as originally supplied. By packaging we mean, software, hardware, manuals,
accessories and of course the retail box or original packaging used
to ship the goods. The retail box is required to ensure we can also
return these goods to the manufacturer and or offer them for sale as
2nd hand items at a reduced price to help minimise our losses.
If we fail to deliver within the agreed time then you may send us a
written cancellation preferably by email and we will cancel your order
and arrange to refund any payments you have made to us. The onus is
on the customer to cancel the order before the goods are shipped from
the distributor or manufacturer to ourselves, although this does not
affect your statutory rights as a retail consumer. We hope our genuine
customers will appreciate that it is difficult to cancel an order once
the goods have been shipped. If we anticipate that we are not able to
ship your order within 5 days then we will contact you on the telephone
number you have given us. You will receive an automatic confirmation
of your order via e-mail and a further e-mail will be sent when the
goods are actually dispatched. If the customer fails to cancel the order
before we have shipped the goods and when permissible within 7 days
then chooses to return the goods to ourselves the customer is required
to pay for the cost of returning the goods to ourselves. These terms
only apply to retail consumers and do not apply to certain business
to business customers.

All complaints will be acknowledged within 7 working days and we will
advise you of how long the situation will take to resolve. We take complaints

Calls are charged at the standard rates as applied by your own telephone

Customer Security
Security at FreeSurf Ltd is handled by the Chief Technician who
will regularly review the security of our system, making sure that all
changes to the system are made in a secure way and in line with the
security recommendations of any 3rd party suppliers. More detailed information

Invitation to Which? On-line Customers
Please feel free to visit Which? on-line and comment about the service
you have received from our company. If you feel you would like to complain
about us to which? readers, we hope you will first use our internal
complaints procedure, which will allow us to deal with your complaint
swiftly and hopefully satisfy totally your complaint.
Warranty & Liability
FreeSurf Ltd does not provide warranties on any merchandise. Any
warranty or promises made by the manufacturers are solely their liability
(subject to applicable Consumer Legislation). We do not exclude our
liability for fraud, death or personal injury. In no event shall the
Company be liable for any special, incidental, indirect or consequential
damages whatsoever (including, without limitation, damages for loss
of business profits, business interruption, loss of business information,
or any other pecuniary loss) arising out of the use of the information
made available on this web site.
Supply Of Goods
Goods are not supplied on a trial basis, please therefore check compatibility
with the manufacturer or other competent body prior to ordering.
THE CONSUMER PROTECTION (DISTANCE SELLING) REGULATIONS 2000
Please note the right to cancel does not extend to Business Customers
or to any goods which are collected from our Headquarters. Neither does
your right to cancel extend to opened Software, Video or Audio.
Business &Trade customers getting special trade prices for re-sale
purposes should note that many of the terms and conditions above only
apply to to retail consumers as is required under law.
Our terms and conditions do not affect your statutory rights as a retail
consumer.
Notwithstanding the above noted points, all sales are made according
to these Terms and Conditions.
